Why isn't IV a national member of the Reform Immigration for America Campaign? If you take a look at the list of participating organizations Organizations � Reform Immigration For America (http://reformimmigrationforamerica.org/about/organizations/) you'll only see that the TX state chapter has signed on. Core group, could one of you take a look and sign-up? Would IV consider cooridnating events with them during 2010?

Your education evaluation is valid for a long period(not sure how long). I applied for my first H1 in 2000 and got education evaluation that time. Stamping didnot work out for me that time.
I applied for new H1 in 2003 and submitted same education evaluation that I got in 2000. I entered US and used same edu eval for transferring H1. I did not have any issues.
So you are fine. I dont know if this applies to all cases.

My current company's CEO is retiring and the other partners are forming a new company. The current company will continue as a corporation and in the new corporation the current CEO will have 10% share. The new co will start with the current client base, employees, equipment, web site and use the current company's name as a DBA.
I am on H1-B visa with the current company and in the process for Permanent Residency with my I-140 approved and awaiting for the Priority Date to become current .
If the current company terminated me and i got re-hired with the new co.. what would i need to do for my H1-B visa and the Green card process. Please advice ASAP.

Folks;
My bro is trying to schedule appointment at Calgary, AB consulate for visitor visa thru nvars.com. And it says their are no appointments for month of Sept., and Oct. When he tries to look in Nov., system says you can only schedule appointments upto 8 weeks only.
I guess is this what you have also expereienced lately in similar situation?

I have exactly the same question.
If you look at VFS appointment scheduling if it is more than 1 year that your 797 was renewed and if you did not go for stamping they put you under different class of renewal.
You can check this by going to VFS appointment site and there they ask the question are you applying for the same class of visa that got expired 1 yr ago or something like that...
Can anyone shed some light on this. Since i am on the same boat like the person who asked this question.

The fees for most CIS applications are astronomical. For instance the fee for N-400 to become a US Citizen is $675/- The fee for adjusting status to become a permanent resident is $1010/- Many people simply cannot afford that. However previously there were no forms and no guidelines to filing anything without fees with the CIS. If anyone filed a form and could not afford a fee, they had to write a letter. But the mailroom personnel at CIS either does not read or perhaps cannot read. So the form used to be returned asking us to send the check. You could go back and forth and in the mean time loose time or even status.
Even more egregious were fees paid due to CIS' mistake. For instance if the CIS in clear cut error denied your case, you had to file a motion to reopen for $585/- We even had a case once where the CIS collected a fee for a I-765 (EAD) filing for $340/- and lost the file. When we traced and send them the check, the reply was that my bank should ask for the money back. My bank, Bank of America, did not know how to. So we simply paid again and refiled.
Now the CIS is proposing a form: I-912 which will establish clear guidelines for fee waivers. Hopefully the form in its approved version will have no fee requirements for CIS' mistakes along with applications for applicants below the poverty level.
Don't just start spending the money that you were saving for the CIS fees yet though. Sometimes these forms take years to come to fruition. As for me, I will believe it when I ultimately see it.

Population of all developed countries is in decline. So they are encouraging young people from other countries to support their economies. Now with so many baby boomers starting to retire, the working population of USA is not just stabilizing as he chose to say but going to decline. To support the US economy it needs young people to immigrate so that the baby boomers like himself can keep getting their social security checks in mail. So his argument is not persuasive enough to people who know better. But the problem is most people who don't know enough about immigration or economy can easily be brainwashed to become anti-immigration with this kind of pseudologic hogwash.

Today Immigration Customs and Enforcement ("ICE") (http://www.ice.gov/pi/nr/0909/090910elcentro.htm) announced an arrangement with Imperial County Sheriff's Department in which individuals during the booking process will have their biometric data checked with Department of Homeland Security ("DHS") data and FBI data to determine whether or not they are in the United States illegally. When a person's fingerprints match those of someone in DHS' biometric data system, ICE is automatically notified. ICE will then take steps to determine the individual's immigration status and then take appropriate action after the offender completes his or her prison term.
ICE already has agreements with Los Angeles County and San Diego County. Nationwide coverage is expected by 2013.

Hello,
My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.
I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.
Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?
I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!

Hi, My H1B on passport is expiring in mid Jan 2008. Similarly, I-94 is also expiring same time. I applied AOS in last week of July and hoping that I will get EAD by Dec but if it does not come by then, what are my options ? If I apply H1 in first week of Jan , would that be okay as I will have expired H1B stamp and I-94 in my passport. Please advise.

My sponsoring company changed its� legal name on January 1, 2008 for some restructuring reasons. I got saved, as I�m July 2, 2007 I-485 filer (I ended up completing 6 months after I-485 with filing employer).
Our corporate attorney has advised us that, they would invoke AC21 only if RFE received.
Now, I�m looking else where for a new job � I plan to invoke AC21 only if RFE is received. However, I�m concerned that my employer may try to revoke I-140 (Note # On Behest of my �Desi� manager who has pinned me down on several occasions due to my pending GC application)
My question is � since filing employer no longer exists (legally), would my current employer be able to revoke I-140?
I would appreciate insight from Guru�s on this forum!

I am a student on an I20/M1 vis
I have just recieved a new I20, and sent a form I 539 for extension of my I20.
I have my old I94, I20 etc.
It is currently under processing.
First, is there any way they can move it to another processing center? Its in the vermont center right now, and they are still processing documents from May 2008 according to CIS website.
Second, my original I94 is valid till 14 April 2009 but my original I20 is expired.
My visa is 5 years(M1 valid to 2013)
Can I go and visit my home country with the old I94(since its valid long enough) and new I20(which just got issued)??
or do I need to wait until the processing comes through?

Use I-134 instead which is used for EB petitions.
