Why don't you go and get the visa stamped in chennai consulate or wherever it is applicable to you.
If you have an AP you don't have to worry about anything since you can use it when you come back.

What is a probable timeline for Eb3 to Eb2 porting ? If we are already using EB3 EAD and not renewed old H1b, is it still possible to apply for Eb2 labor ?

I'm in the same boat as you are and thinking of pursuing EB2 with the same employer as there is a position in the company that requires 9 years of experience and a master's degree. I've got over 13 years of experience and hoping to opt for the EB2 process soon.

Hello All,
I am a silent reader of Immigration voice forum and have got great information about H1B and other related issues on this forum.. Today, I am in dilemma as what to do in following situation and I thought you all will be able to help me by answering my questions. Here I go:
I am on H1B and my wife [on H4] graduated [MS] in Dec'06. Because she completed her MS in Rehabilitation counseling on H4, she does not have OPT to start the work. Now, she has got a job offer from private rehab firm and they are ready to file her H1. I would like to know following:
1. Is she eligible for 20000 MS quota exemption?
2. According to H1B visa reform act of 2004, such exempt applications were allowed to be filed on March 8, 2005 for FY2006. Is this the case for future fiscals as well?
3. If the H1B application is filed by lawyer say on April 1, 2007 in premium processing, can it be approved in 15-20 days i.e say April 15.
3. If she gets the I-797 on April 15, what will be the start date on it? Will that be October 1 or can she get earlier start date i.e. Say April 15, 2007?
The problem is if the visa start date is October 1, 2007 then the employer might not be ready to wait that long.. In that case, what are our options?

In an interview on David Letterman (http://www.youtube.com/watch?v=xpvNXPPOMr8), actor Robert Downey, Jr., talked about a problem he had last year in Japan, when upon entering he was detained and questioned about his past criminal record. Downey said: I probably should have seen there was a sign that said 'No Felons Allowed' in English and Japanese and I haven't had that expunged yet," he said. "You can actually get things expunged but I've been pretty busy. So I was detained, I was interrogated. It was a blast.
Haven't you settled up? Haven't you paid your debts? Letterman asked.
Clearly I haven't paid my debts to Japan, said Downey.
While I certainly feel somewhat bad for Mr. Downey, this short exchange gave the impression that nothing similar would ever happen in America! Hah!
U.S. Immigration Law contains restrictions that bar entry to people forever, for virtually any youthful indiscretion they have ever had, e.g. simple possession of a marijuana 20 years ago, without regard to whether or not you were actually convicted of the crime! You do not even need to have been convicted; the fact that you admit you did it will also get you barred from entry. Heck you will even be bounced (http://www.markshuttleworth.com/archives/43) from the United States after overstaying your visa for one day, leaving one day late, and then trying to come back in on that visa. Or, you will be detained and returned because the officer thinks you MIGHT be working (http://addxorrol.blogspot.com/2007/07/ive-been-denied-entry-to-us-essentially.html).
So, if you were watching David Letterman and thanking your lucky stars that America is far nicer to arriving tourists than Japan--think again!

Go to nearby embassy and inform about your situation. Make sure to keep all the documents and all also duplicate copy of your visa. Hopefully everything will be fine.

I was in a similar situation. I emailed to this address info@phi.dflc.us from my company email. I didn't put anything else ( as per advice in some other forums). Received reply with the case number after a month. Meanwhile I received 45 days letter and so not worried much. As we all know this is a hit and miss. They may reply..but won't hurt to try.

Political scene and policy making is mostly based on vote and voice more then TRUE reform. Always, be it India or USA.
Immigration-Voice is primarily for legal immigrants. Even though we input substantial economic value to the society, and to the fate of all of us the small legal/skilled people immigration reform is tied to the big CIR.
What I want to propose is to talking to other lobbing groups and immigrant associations.
Irish, Spanish etc... Today in the news the Irish Lobby for Immigration Reform (ILIR) made a big show and seems like they have got lot attention. Form senator Clinton to one time Irish Kennedy all spoke for Irish and CIR.
Also, Immigration voice is primarily supported by Indians and few other people from other nationalities.
In addition, I being an Indian like to propose bringing more attention and contributions to the situation by talking to local and north American Indian associations both professional and cultural.
To name a few...

Telugu Association of North America
American Telugu Association
FOGANA - Federation of Gujarati Associations of North America
Federation of Tamil Sangams of North America etc..
