    Section 245(i) is a part of the INA. In 2001, this section was updated to allow people present illegally to submit a labor certification. This resulted in the DOL getting 6 years worth of applications in April 2001. These applications led to the establishment of the Backlog Elimination Centers and the PERM process. The applications filed 6 years ago are still being processed by the DOL..

    At this point I am neutral on the DREAM act. Before I can support the DREAM act you need to prove how it helps children of legal immigrants. I suspect there is more to your story than you are letting on. If you are 21 now, you would have been 19 in 2005 and well able to understand the consequences of becoming an illegal immigrant. As someone said the F1 was an option if you wanted to maintain legal status.

    Iam in the very same position. I do not have kids and thus do little research on the acts pertaining to this situation. But I am all for doing my part, if someone can explain and provide relevant links on how this will impact the EB community. I have no qualms in admitting that Iam in IV only to support the EB cause (it also helps me). I do not want IV to take up a cause that will have a dilutive effect on EB cause.

    I think, it is a combination of three things.
    1. Laziness
    2. No Accountability
    2. Bad intentions ...as you mentioned

    In my job, I am a software trainer. I teach hundreds of people. I will be accountable (and asked questions) if I delay my work even by one day. There are tight deadlines for everything. (Yes, 5 minute job of renewing EAD will not be 90 days ...it will be 5 minutes only) Even if one customer just soft complains about anything, I will be held accountable and my job will be in jeopardy. There is no such thing in USCIS.

    BTW: I hate when they say 90 days and then exclude the RFE time and the mail accepting time.(They count from the date of receipt and not the date of receiving the mail). On the top of it, the receipt date can be any time they want and not the date of receiving the date. It can become 120 days and when they say "days", it is like one of those commercials which says, " for only 1$ a day ...." instead of saying $365 which they charge for the whole year . subscription.

    Same way instead of saying 3 to 5 months , they say 90 days (so that it does not seem long). they should say , "EAD RENEWAL ONLY TAKES 129600 MINUTES". ..and then in the small print, light gray color at a hidden spot in the bottom, in tons of lines of text, say, "does not include RFE, holidays, Mail transit time, and time before we accept it"

    Can anybody please send me the address of USCIS director ? I want to write a letter to him with a copy to his boss too. Anybody can help me know who his boss is and his address too ?

    You will be barking up the wrong tree or up the same tree a lot of us have already barked up to, by writing to rthe Director of USCIS and his boss.
    Alejandro Mayorkas is the Director od USCIS and I believe his boss would be none other than Ms. Janet Napolitano..

    Laziness and Un-accountability are hallmarks of any government organization in any country, so we can discount that. I strongly incline in the direction of "Bad Intentions".

    Afterall these are all clerk level employees who have, what amounts to the future of thousands of people, in their hands. Whenever USICS efficiency/operating procedures are discussed here, I am reminded of what a clerk in my engineering school in India once told me. Mind you, this was NOT a government office where dealinggs of millions of rupees are made. This was a SCHOOL.
    Following is the brief dialoge between the clerk and I:
    Clerk: "Bhai, clerk se hamesha dar ke rehna."

    Me" "Kyon?"

    Clerk:" KUTTA mein ek (one) "K" ( the hindi letter Ka), hota hai aur clerk mei 2, is liya dhyan rakha"

    1) My screen name has nothing to do with the argument here. If we discuss my screen name we are going on a tangent which is very typical of desis (I rememeber womanly taunts in movies and woman gossip where they would pick anything but would niether make a point nor a valid argument)

    so you can see where your argument is going..

    2) Hopefull signifies optimism. A pessimist is an optimist who is very analytical or knows better. Your argument is similar to "And they lived happily ever after ...(after singing around green trees) ...." ignoring the ground reality, facts that no dent has been made and also turninga blind eye to the fact that there are people since 2001/2002 stuck. Its 2007 meaning five years and if the Dept is not willing to budge after all these efforts to a number more than 7000, and you still are HOPEFULL ignoring the facts means that you are an idiot. Yes you will get your GC before you die for sure provided you live upto the age of appx 70 and your consulting firm is around and you are not tired of the bickering with your employer.

    Its just like a Yash Chora SRK movie ...it only happens in reel life and not real life ..

    3) as far as the FT job goes we both knwo it deep within what it means...i hope you are smart enough to get the point and wont make me word it to emabrass you further..

    4) if you would be intelligent enough to shed some light on how kindness and make you get your GC in thsi scenario ...

    just a piece of advise ..STOP BEING DUMB

    Guys.. plz stop responding to him. He is just one frustrated soul. Hope he finds happiness around him and distribute the same to the people around him.

    After getting the EAD/AP within three months, I don't think our problem is solved already. We will be at certain point in time be in the same situation as the poster above.
    Who told you that you will get EAD/AP in three months. Nothing will prevent USCIS to develop backlogs in EAD/AP too now. "Oh there were so many filed in June/July so that we can't process them that fast anymore...":cool:

    Can you copy and paste the exact letter, i mean to ask the exact letter means does it contain any agent id.

    1. Did you opened any SR in TSC around 10/14 or 10/15, We have a group of people who had the same problem in TSC during those days. all the letters replied by the same agent.

    2. Find out from attorney if he charges any fee for this. If so please don't go with him.
    take an info pass and find out the details.
    This is the best way to find out. (As i told you the group of people got the same response, most of them took info pass and found that nothing wrong in their case)

    Nothing to worry, most of the cases it might be a mistake by the agent. or in some cases it is pending for minor verification.

    The status of the service request is: ur case is on holf becoz u appear 2 b inadmissible under the current law.Rather than denying ur application based on inadmissibilty,we r placing ur case on hold while the dept of homeland sec considers additional xcercise of the Sec of Homeland security's discretionary xemption authority.Such an xcercise of xemption might allow us to approve ur case"........................PLS ADVICE .What happend to ur case?What did ur lawyer advice.I have taken an appt. wt my lawyer but he is out of town and seems it will take sometime...

    Someone I know was EB3 I Aug 2001. They had filed for I-485 sometime in 2005. They got their GC on 12/22/2008.

    Their lawyer filed a Writ of Mandamus against USCIS in Aug 2008. The deal was the USCIS was to either approve or reject their case in 60 days.. So, check with your attorney and see if filing a case in an option for you.

    well you guys are the kings of jumping ahead of the line using labor substitution...how can any of us be knowledgable on the subject...contact unitednations or ppl like him who "help" the skirters of the law.

    svan77: if a person posts on a forum he or she will get the opinions of members whether he/she likes it or not. all of us have our beef with labor substitors and ppl with 3 yr degrees or aptec/niit diplomas who just believe in jumping ahead of the line and have no qualms about it.

    First, Thank You for all your advises.

    I am planning to file AC-21 memo with USCIS.

    I hope the my new employer will help with paperwork. and I have to find a lawyer who can do that and be prepare for RFE and Interviews.

    My last question to you:

    1. Do you know for AC-21 I have to work in the same state where my labor was filed?

    my labor was at IL and now working in TX but same type of job.

    2. Is there a deadline or recommened time to file Ac-21 memo with CIS?

    I just joined the new company 2 weeks back with my EAD after getting laid off from petitioning employer (they will not revoke my approved I-140)

    Any advises and recommendations on filing AC-21 will be very much appreciated.

    I believe YES, required checks were issue from the law firm's account, No personal.

    what is this? there are delivered date and received date with received date before the delivered date. How can they receive before the delivery. Hmmm Did USCIS guys ran early morning 4 O Clock to UPS/ FED-EX/ ETC to receive the app before those guys attempted to deliver :) Even if someone says, "YES", there was 6 days difference between those two days. No idea what USCIS is doing.
