Hi all,
I am on H4 for the past few years. This year I am planning to switch to H1. A consulting firm of only 5 employees is willing to sponsor my H1. I would like to know the chances of my H1 getting approved. Because the company is small am I going to face any problems? What will be the impact of the size of the company on H1 approvals.
I would really appreciate your inputs because this time I want to resume my career again and I don't want to have any problems with H1.

The only document that I know that suit the name " Unemployment Wage Report" is IRS Form 940-Employer's Annual Federal Unemployment (FUTA) Tax
Return.
The probable reason of asking-to verify, that Company is sound, paying salary, wages, then taxes, including unemployment tax.
The company's Tax Return also shows how's company doing financially,economically, if it able to pay their employees salaries and what business this company stated as her primary.
Therefore, I think, that asking for these docs seams as reasonable, keeping in mind that consulates and embassies belong to different department than DHS and USCIS.

That was taken last October on the Island of Dominica at a place called Emerald Pool (believed to be the "fountain of youth" by the locals). The girl in the pic is my girlfriend's sister and didn't mind playing model for me. :)
I'll try to find a color shot of the pool and waterfall for you. Very nice place, buried in the rain forest.

The President has started revealing his plans on immigration for the next year. It sounds like he's planning on trying a do-over with Congress and attempting again to get a comprehensive immigration bill passed. He'll make the case for this in his State of the Union Address. I'm happy the President is still interested in working for change, I sincerely hope he is not making passing a reform bill his SOLE strategy. I'm reminded of Presidents in the past who regularly spoke in favor of something, but you just knew they didn't really care and were just trying to appease...

When my attorney filed the I-485 last month, he mentioned the correct name and the mispelled name in the brackets.
Any comments from senior members will be helpful.

I think many Indians might have faced this issue.We can spell same Indian name in several ways in English.
I have one friend who is ready to file I -485.
He found following issues with Birth certificate. Does USCIS rejects or REF I-485 for following reason ?
1) His mother�s name spelled differently in his Birth Certificate. (One letter is missing)
2) His wife's Birth Affidavit has different spelling for Father�s name. (One letter is different)
3) Is first name enought in Birth Certificate or it needs full name ?
Keep on good work of helping each other.

My EB2 I-140 got approved during 1st week of April and USCIS successfully ported my EB3 priority date of Jan, 2006 to the new EB2 I-140. As per my attorney, interfiling shouldn't be done as I have been with same employer all along and same employer sponsored for my porting. The attorney says, this should be automatically taken care of by USCIS.
My question is...I couldn't find the proper procedure/documentation for my scenario. Did any body come across this situation and can any one offer any suggestion?

I have been arrested on Domestic Violence call by my wife ( of cource false allegations) about month back. Police investigation did not find any evidences and never sent file to DA for filing hence DA never filed charges.
Now USCIS requesting following
1) Please submit an arrest record and final court dispositions for each of your arrests. Court dispositions must be in the original and bear the stamp and/r seal of the appropriate court or clerk. If a court disposition or police record is not available, you must provide official or certified evidence from the appropriate law enforcement agency or court confirming the record in unavailable. Please note, these documents must either be the original or certified copy.
How to get court deposition or evidence that no charge are filed against this arrest?
I have filed petition for expunging arrest record but that will take a while to conclude.
Please advice what proof I can send to USCIS that this arrest did not even result in charges in court.

I'm in same boat, upgraded to PP on June 1. your new status of I140 will be "We received request for PP".
For H1's Ext its the same receipt number . I think for 140 it will be the same .I subscribed to the notification of case status and i received an update oon the case saying the Premium processing requested for the petition

FATCA establishes a MINIMUM penalty of $10,000 for failure to report foreign ASSETS over $50,000 on your tax return. FATCA filing is required in addition to FBAR filing. Who ever filed FBAR, please be aware of this new law from next year onwards , since the penalty is so high.

Based on your approved I-140 if you are eligible to file 485 or get EAD then he can also get EAD.
But using only approved I-140 , then only the beneficiary can get extended.

Yeah many people got the I-140 update who files in July. What was your PD on LC Sub? If you pD was too old then you would have got your GC by now.
