Hi All,
I applied I765 in Jan 2011...but its in initial review state now(Nebraska).
Because of some urgent reason i have to leave US in April ...& no such fiexed plan to come back in US near future.
So m planning to withdraw i765 application...So anybody knows answer to my questions,
1.what is the procedure to withdraw?
2.Whats a address for Mail OR Email OR Phone Number?
3.What information do i need to submit?
4.How much time it will take to withdraw?

Hi
I'm currently working on L1B visa from company A. My present employer applied H1B visa also for me and it got approved around in the August last year. Now I'm planning to change my visa status to H1B.
So I would like to know the options that I have to get my visa status changed to H1b.
1) Can I transfer my H1B to some other company now as my H1B already approved? Is it possible?
If it is, how can I change my status?
2) What is the procedure if I have my current employer do my visa status changed to H1B? Do I need to leave US and come back to take that effect?
Please kindly reply to my questions.

You can even take an unpaid job/volunteer to keep you clear of the 90 days unemployed clause.
I didnt know that even the OPT rules have changed now. This is a mess.
Now OPT also you cant remain unemployed for more than 90 days. Now this OPT is becoming like another H1B.

I am working on EAD which I received from my EB3 category(labor date - Oct, 2004). My new employer filed a new application for EB2 category in Nov, 2010, my labor got approved within 3 months and they went for the next step filing my I-140 PETITION. They attached my previous I-140( from Eb3 category) along with the new application seeking to port the old priority date. Here is the REF which they received on 23, March 2011.
"Please provide evidence to show that the petitioner will be employing the beneficiary to fill the specific vacancy. In addition, provide a detail description of the work to be performed, including specific job duties, level of responsibility and number of hours per week of work to be performed.
You must sumbit the requested information within 30 days from the date of this letter. Failure to do so may result in the denial of your petition"
Please suggest. My attorney is working on this.

Here's another article discussing the embarrassment that is CNN's Lou Dobbs Tonight. The Obama administration announced a crackdown on Wednesday on hundreds of companies suspected of employing illegal immigrants, signaling a shift in strategy: going after employers instead of workers.
However, it is yet to know what steps the government would pursue if it verified that an employer had hired illegal workers, or how severe penalties might be. It remains to be seen how much pressure the new policy could put on employers. that is required to be maintained by the employer for all employees (even US Citizens)

Some big compromises in the House version that dropped this morning. First, there will be $2525 in filing fees, $525 of which is due at the outset and $2000 of which is paid five years in to the ten year conditional non-immigrant period. That should presumably answer critics who complain that DREAM will add to the deficity. Also, conditional status is granted in two five year terms and the college education/military service requirements must be met in the first five year term in order to get the extension approved. Ok for a long time I have been thinking about getting enrolled in a Phd program and this year I was hoping I get a chance to chase my dream after having the GC... well it did not work the way I thought/planed and now I want to weigh my options.

So my questions is:
Is there a way I can join a univ as full time research student?
Can I take a leave of absense (ofcourse w/o pay) from my current job to join as a student?

This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. We will update once we have the California Service Center Numbers.

I am in an awkward position and any help will be greatly appreciated. Here is the run down:
- I am currently on an H1B that is scheduled to expire on May 15th, 2007 as per the stamp on my passport.
- I have accepted employment with another organization based on my EAD (485+140).
- The catch is that I plan to re-enter the US on April 21st, 2007(Saturday) but technically my employment will cease with the employer who filed my H1B on April 20th (Friday).
- I have applied for my travel document (I131-based on 485) but it will probably not arrive before I leave the country.
Questions:
- Can I re-enter on my H1B, although technically my employment ceased a day earlier?
- When do H1B�s technically expire after termination of employment?

I just received the I-140 Receipt Notice and noticed that the section I am filed is not correct Sec.203(b)(1)(c) i.e multi-national Executive or Manger
where as I should have been filed for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professionsal
I am going through Substitution process and the Previous I-140 was approved for sec.203(b)(3)(A)(i) or (ii) Skilled Worker or Professional
Now my question is what is the procedure to rectify this ? Also will I hold on to the processing dates {NOT Priority date} (say May 25th) for I-140 or should the lawyer file new appliaction which will push my I-140 petition dates to June?
