Hunter, this is the first sensible post from you. Now you agree that abusers of this H1 visa system are corporations not the immigrants on their own. So far you were busy bashing immigrants.
Also if US is a free market and capitalist society, why should corporates employ "whoever" is locally available. Its a private money afterall. Shouldent it be upto them to decide how to spend? Also most US corps, have local presence and as for taking a tax break, I hope companies did not promise to create "ALL" jobs in US. Majority of local jobs go to US citizens. They still create thousands of local jobs and pay H1 visa fees part of which goes to train american workforce. If the wages were equal, its more expensive for a company to hire H1 worker.

We wasted lot of time, money and effort with this 485 filing for the last 15 days. I am terribly disappointed with the outcome now.
We need to file a lawsuit against USCIS and Dept of State for the loss that has happened to us.

I am sure you must have thought a lot before the 'foreclosure' came into your mind. Here is an advice. If there is not too much that you will have to put out from your own pocket, then it is better to take the hit and move on.
If you do foreclose, it might not be the best for credit history as well as in some random cases, job search. Jobs usually do a background check and that includes credit check in some cases as well. I hope it has no bearing but in some cases can. I don't think it will have any impact on your GC. Even if you don't have plans to buy a house, there are far more things that can impact. None of us want to live on credit but in US it is almost a necessary evil. Car, credit cards and the other nine yards that come with it also become scarce for the next few years. So, tread carefully.

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

I sent 20 posters today by smail mail and now I have already called 12 member's offices. Please call them and make them hear only about 5882 till this is cleared. I am telling them " I am so n so, calling from x, and this is to request Mr. to support the Visa recapture bill for LEGAL IMMIGRANTS, HR 5882. Please call. More voices can only be heard loud. Lets join hands.. Together we can make it..

This Lawsuit Idea is on hold for the following reasons:
a) Not enough interest in the affected parties
b) Cost of the litigation would be upwards of around 30K
c) The counsel has recommended to hold discussions with USCIS official first and give them sufficient time to respond to our concerns.

Here is another case of a person I came across recently. This person was stuck for the past 5 years in Namechecks . He applied for GC in 2001. He got his GC just recently after a long wait and struggle.

Let me make one thing clear. Govt has defined EB categories : EB1 , Eb2 and EB3 . based on level of exp and education etc..
Now that your employer has applied for you in Eb3 even though you were qualified under Eb1 or Eb2 then govt can't do any thing. Like if you are making 70k with 5 years exp and which is ok as per your labor cert of H1b then govt cannot do any thing . Even though u r less paid compare to market.
same thing here.. If you think you can qualify for Eb2 and your employer want to apply as EB2 . It should not be issue. You are most welcome to do so. But I see common ground as HR 5882. Why dont we work hard and hard to get HR 5882 pass. One of my friend has MS from USA from top uni. with 18 years of exp from India and 3 years of exp in big 5 from USA. Still his recent employer applied under Eb3 . Should he complained to govt ???

No matter what way you fight govt wont agree to give high priority to Eb3 compare to Eb1 or Eb2 . as from VDLRAO's post Eb2 does not need much visa to become current so if we get recaptured visa then eb2 will be current and Eb3 will get most of visa out of those recaptured visa.

Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. It is all because most people want free lunches. This needs to stop. The 200 people going to DC tomorrow are going to speak for you and me for yours and mine greencard. They are taking time off and spending own money for you and me. Nothing is free in this world. IV is also doing this for you and me and we are taking it for granted. Hi,
I was scheduled to travel outside US this summer for about 3 months. Then dates move past my PD and I have to apply for 485 in june. I have discussed these with the lawyer and want to confirm what she is telling me:
1) I have to be in the country to apply for 485.
2) FP notice will likely arrive in 3-4 weeks. But we have 84 days to reschedule this if needed.
3) I was not planning on applying for EAD/AP at this time. However, she says that if I leave the country on H1, and 485 is approved while I am out of the country (HIGHLY unlikely but still possible), then I cannot come back into the country unless I have an AP. (This is the point that I mainly need clarification on!)
4) If I DO apply for EAD/AP then I cannot leave the country until they are approved.
5) Finally she cannot give me a timeline for how long EAD/AP would take. The service centers processing times show that they are currently processing Jan cases. Which means at least 4 months wait after applying for EAD/AP.
Does any one know if any of the first four points are wrong. If so, what is your knowledge about the point that is wrong. Also, does anyone have any idea on point 5 (i.e. how long it is taking for EAD and/or AP these days).

It looks like atleast 75% of EB2 I with priority dates 2004 seems to be approved, this should bring down the count of 2004 less than 1000 may be little more than 1000.

There is no change in my wife's 485 status. But her EAD is approved. There is no mention of card production in the email. Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2. After all I don't think DOL is that brain-dead (yet?) to say that somebody with 15 yrs exp is the same as somebody with 1 yr exp although they have the same job title (E.g. Software Engineer title at Google generally has more experience and education than a software engineer title at a desi consulting company even though both fall in job zone 4
Solar power here has inadvertently opened Pandora's box in the process of trying to solve a genuine cause for concern. For most IT people it is going to be very tough to get EB2 classification (especially if you are just out of school and have decided to apply for a green card). It is better for them to look out for research positions and apply under Computer Scientists as this will atleast enable them to apply under EB2. Is this a good thing: If you are non-IT yes, if you are IT no as it just convoluted the process even more.

What's ridiculous about it? Their website say's that you can call any number in India ( land line or cellular ) for free and unlimited time. It clearly says - * Calls to cellular phones included.
