The item mentioned above is for EB2, meaning any spill over to EB2 is from unused EB1.
for EB3 the ACT mentions the following
Visas shall be made available, in a number not to exceed 28.6 percent of such worldwide level, plus any visas not required for the classes specified in paragraphs (1) and (2), to the following classes of aliens who are not described in paragraph (2):
The meaning is EB3 gets all unused from EB1 and EB2... This is the catch, does this mean spillover from EB1 after EB2 catches up (or) spillover from EB1 even if EB2 is not current..
If they have done spillover from EB1 to EB3, even when EB2 is not current...we can give this a try.

Lost in all this is the fact that Punjabi wants to sell his house not because he cannot afford it anymore, but because he wants to move to a different city to a higher paying job and can't be bothered to take responsibility for his failed real estate venture. He could have done the ethical thing and stayed in his present job and paid off his loan but he is choosing not to. And who does he blame for his situation? The concept of the "American dream". So the fact that he wants to shirk his responsibilities in favor of foisting his own debt onto the rest of the country isn't his own fault, it's the "American Dream" that's making him do this. It's not exigent financial circumstances that are causing him to foreclose, it is greed and shortsightedness (colloquially known as "The American Dream"). Greed and shortsightedness already caused him to go 20K under the water. And they will now make him screw up his own credit history. If someone cannot learn from one mistake, I say let him keep making mistakes. He will soon find out how difficult life in the US can be if you don't have a good credit history. As for the burden on us taxpayers, hey, we've been spending 10 billion a week for the past 5 years dropping bombs on people, what's a mere 20K?

Ok, I had hoped not to bite the bait, but I am human, nothing recharges and roils like someone saying "you are EB3, you are worthless compared to US the mighty EB2s".
The misleading continues
1) "VDLRAO" (no disrespect to his prediction capabilities) says EB2 will be current soon, so why are you raising this voice.
Well, if it is going to be current soon enough, then any action to redirect EB1 numbers should not be a cause of concern for EB2s should it? If you are going to become current soon, then it means there aren't many people waiting in the queue.
2) We should support the visa recapture
You all are assuming that EB3 does not support it. Unlike me, most EB3s are very active in calling, contributing and supporting those events. I have personal reservations about asking for a change in law when I am the direct beneficiary (I feel like those big oil companies who use their clout to get laws favourable to them, nothing wrong, just that I dont like to do it). Having said that, I have no problems in asking and demanding that the law be applied as written.
Once I have my GC done with, I intend to write to the representatives that barring progressive experience in the same company rule should be removed, because it is the experience that matters, not where you get it. Why should someone who chooses to be loyal be discriminated against another who has no qualms about his company's future.

Some within EB2 concede that the law is fuzzy, while others claim there is no basis for our campaign here. This is what i am doing to call a cell phone or any land line in india. Vonage has a call forwarding feature. Simply log in to your vonage account and go to features and configure the call forwarding feature.Configure such that the call is forwarded after 20 sec's. Intially vonage rings and after that it is forwarded to the india cell or landline forwarding number. Its free of charge as calling from vonage to india #'s is free. Hope this puts the debate to rest.
I already took Vonage world phone. I am happy with it. However, I happened to see somewhere in the thread about Lingo offering india calling even through the mobile. That had me give a second thought on switching over to Lingo.
However, when I read the fine print on the lingo site, it mentions you cannot call Mobile phones in India. This catch makes me go crazy. Can some one confirm how are they handling with this constraint. Is that still a good option to switch over vonage to lingo based on this single feature?

To set the record straight.....Mr. Hunter should first learn English Grammar. It's "I have been" not "I has been". And yeah, don't get lost in statistics, just because laws in US are designed to encourage corporate fraud in variety of forms doesn't mean corruption is any less. The only difference is low grass-roots level corruption which is direct result of differences in population density.

Did anyone see any Soft LUDs on their 485 or old EADs before their approvals/RFEs?
My PD is June 7 2006, not current. Yesterday, I had a soft LUD on my 485 and my first EAD. These two haven't seen any activity since early 2009, and I'm wondering if this means anything or if I'm reading into this a little too much.

I request some help on how to proceed and what is required for self filing 485 for child born in India. We have already filed 485 3 yrs ago and awaiting Approval( delayed due to retrogression). Now since the dates have become current we would like to add our child who was born in India and currently living with us here ( we are still maintaining H1 and H4 status valid). I wanted to find out what documents and letter( to build the case) is required for adding our child to the application. Also would like to find out if we need to attach our child to existing application(mother or father) or file is seperately. Anybody please advise

In fact lately, judges have even upheld firings of smokers from certain companies.
IF there is a pattern of discrimination based on age, sex, national origin etc etc. THEN you can sue.. but NOT just because you don't like the policy of the employers..
People don't realize it but US laws actually give plenty of leeway to employers related to that.. only relevent law applying here would be "EEO" and that doesn't mention anything related to EAD.
Legally you don't have a leg to stand on.. but you can try.. tell the lawyer , they have chance to set precedent!

Why do think they will stop keeping any buffer?
