I was asking for Ideas.. it is not just Kumar or some more people giving an idea that one should leave the house if the value of the house has gone down and now you have to move because of ur job and it is hard selling ur house where u may have to bear a loss ..
I already had conversation with american people ( not any desi's) in my office and they also had the same opinion as to leave a house if u have to leave because of job..
U tell me how wise it is to give a loan to a person without a down payment..The reason i said that other people are stupid is because.. i took an ARM loan of 5 years,, where i knew that i am not going to live in the house for more than 3 years and will later sell it..and there are people who knew that they are going to stay in the same house for more than their ARM period.. but didnt realize that they wont be able to make payment once the rate is re-adjusted.. i am calling those people's decision as stupid..

i can sell the house for a loss of may be 20,000.. but why should i pay that money from my pocket.. i can keep that in my savings account and use it in my bad time..

Ok, coming back to your case. I do not have any experience with foreclosure. From your post it seems like you are losing $20k. Well this does not seem a very big amount. Consider the impact of foreclosure, bad credit will mean you will not get any loan. It will be tough to get auto or any other credit. You carry risk with background checks. I think the lending standards will get tough going forward which means you don't know for how long you will not qualify for home. In my opinion, if you have 20k and it is matter of losing some savings, not going to foreclosure looks better option.
I hope you will learn to own up to your own mistakes, it will only make you better person in life. Good luck.

ok this is what I have
a) email with offer of employment and link to I9 form in offer letter
b) accepted verbally
c) background check done and report sent to me
d) called and was chatting when I mentioned EAD, was told sorry we cant offer you employment due to EAD, and that is has to EAD filed by this company only because they cant verify its legality et., one way was for them to do my h1b but they are not hiring h1b right now, so sorry. later they said they would consult with legal and get back to me. however i dont hold out much hope
e) i immediately filled out the i9 form
f) wrote email to them outlining our conversation from d) explaining my surprise (and boy! was a surprised!) and trying to make my case that I was not a risky bet for the company because of how interminably long I have been in this country and my spouse had GC already, but mine was not processed in time before priority date became not current.
g) hr wrote back, acknowledging our conversation and saying that they were not sure and that is why they were going to consult with their legal dept and will talk next week.
All I have are emails and offer letter.
I really dont want to go the legal complaining route if this can be resolved. But I am in a fighting mode. I probably would not have been so upset if I had not turned down other interviews...

Hmmm - not sure because, if the job requires that someone must have security clearance - the job must clearly mention that someone with security clearance is needed. What is the point in hiring a citizen without security clearance (unless they want you to get clearance aftewr hiring)

I also surfed the company website, and looks like they do have some federal clients and based on VA. It looks more like a clerical error than intentional posting. May be, an email to the HR of the company, with supporting links that does not encourage such posting legally will educate / prevent such posting in future. Any other members with in depth knowledge on this.. post your comment. Also job websites like Dice / Monster, etc...should ensure Quality of posting rather than having a disclaimer :)

Friends we all know to get AC21 it takes 6 months from the date of 485/EAD application.
Suppose you get your EAD and say have an extension on H1B also for 3 years. But you have not completed 6 months after date of 485 application. In the mean time you loose your Job, then can we still retain the EAD... with say new employer....

I must say y'all are doing a commendable job. I have contributed $$ and would do so more in the future if needed.
I remember Senate Majority Leader Bill Frist saying that the comprehensive immigration reform bill will be handled in February 2006. Is the schedule still the same. I am keeping my fingers crossed and hope that everyone of us stuck in this immigration hell-hole will get a relief from the comprehensive immigration reform bills that (hopefully) will be passed in 02/06.

I think having vonage is more than just about calling india and the calculated rate of a call per minute.
It gives the customer a home phone too. Remember not every household functions with only cell phones.
So for the convenience of having a home phone and being able to use that same phone for international calls too and getting just one flat rate bill for the whole thing is certainly of value to consumers.

I and my wife both have approved I-140. My PD is Dec 8, 2003 and my wife has Dec 24, 2003. I am applying as beneficiary through my wife's application. Is it possible to use my PD instead? Both are EB3.

I am not sure what is happening. When I went to USCIS during Infopass, the officer at the time told me that my case will be looked upon when the notice date comes up.
MY priority date is april25 2006 and the notice date was 09/18/2007. I didn't believe him. Even I raised the question in one of the forums and other guys shot me down saying the notice date is not important. But now I got an LUD on 09/19/2007 and that was the reason why I raised this question to you as well as HIINVIN66. I am assuming that the applications are looked upon based on the notice dates. If they under EB2, pre adjudcated and visa numbers availaible, MAY BE MAYBE we get green cards. IF not, We have to keep our fingers crossed. Let see what happens.....

Attracting and retaining the best and brightest minds from around the world is in America’s best interest. In February 2006, your Domestic Policy Council issued a report on the American Competitiveness Initiative that recognized the importance of employment-based immigration. The report stated:
“The President also recognizes that enabling the world's most talented and hardest-working individuals to put their skills to work for America will increase our entrepreneurship and our international competitiveness, and will net many high-paying jobs for all Americans. The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals.”
You can advance your stated objective by making common-sense administrative reforms to fix a system that is clearly broken.
Implementing much-needed reforms will also free government resources to focus on pressing national security matters. For example, current rules require the Department of Homeland Security to renew the Employment Authorization Documents (EADs) of hundreds of thousands of legal immigrants each year as those immigrants wait for green cards and permanent residency in the U.S. Rather than renew these EADs annually, the government could renew these documents every three years, freeing countless hours that could be better spent serving the Department’s mission.
The greatest impact of the broken green card process is borne by the legal immigrants and their families. The more than half million highly-skilled legal immigrants already working productively in the United States find themselves trapped in a system that is taking years longer than intended. During this wait for a green card, these immigrants remain trapped in a legal maze, unable to change jobs – even within the same employer – without starting the arduous immigration process over again, and subject to waits that grow longer and longer.
We implore you to exercise your authority to implement administratively these much-needed reforms.
• Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
• Revise the administrative definition of “same or similar” to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
• Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
• Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
• Allow visa revalidation in the United States.
• Reinstate premium processing of Immigrant Petitions.
I urge you to implement these administrative remedies without delay. Action is urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.

Why not an interim AP or ability to travel using Original AP receipt before the actual AP arrives? The AP issue does cause a lot of disruptions in planned vacations or also in cases of unplanned emergencies.
